Terms of service

Welcome to Joyful Tidings. These Terms of Service (the "Terms") govern your use of our website and your purchases from Joyful Tidings ("we," "us"). By placing an order you agree to these Terms and to our Shipping Policy and Returns & Exchanges Policy (shown at checkout as "Refund policy"), which are part of these Terms. Our Privacy Policy explains how we handle your personal information. If you do not agree, please do not use the site.
1. Who may order
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that you are, and that the information you give us is accurate and complete.
2. Personalization — your responsibility
- We reproduce the personalization text you enter exactly as typed — spelling, capitalization, punctuation and order of letters — and we do not rearrange monogram initials or send proofs before we begin. Our fonts support the letters A–Z, numbers and common punctuation; if we cannot stitch what you entered in the font you chose, we will email you before we begin. Your order confirmation shows your personalization exactly as we will make it and is the record of your instructions; please check it as soon as it arrives. Personalized items are final sale except where we made an error; see our Returns & Exchanges Policy.
- You confirm that you have the right to use any name, phrase, logo, artwork or photo you ask us to reproduce, that it does not infringe anyone's trademark, copyright, privacy or publicity rights, and that if it includes another person's name you have their permission to give it to us. Section 11 explains your responsibility if a third party makes a claim about content you supplied.
- We may decline any order whose personalization we consider hateful, obscene, defamatory or otherwise inappropriate, or that we believe infringes someone else's rights. If we decline an order we will refund it in full within 5 business days.
- Each item is finished by hand. Small variations in stitch placement, size and thread shade are part of the craft and are not defects. Colors shown on screens can differ from the actual fabric and thread.
3. Orders, prices and payment
- Placing an order is an offer to buy. The order confirmation email we send automatically acknowledges that we received your order; we accept your order when we begin personalizing it or ship it, whichever comes first. Before then we may decline or cancel it — for example if an item is out of stock, a price or description was listed in error, or we suspect fraud. If we decline or cancel, we refund you in full to your original payment method within 5 business days and let you know.
- All prices are in U.S. dollars. Sales tax is calculated and shown at checkout based on your shipping address. Shipping charges are shown before you pay.
- We try to keep every description, price and photo accurate, but errors happen. If we discover an error that affects an order you have already placed, we will contact you before proceeding: you may confirm the corrected order or cancel it for a full refund. We will never charge you more than the amount you authorized at checkout without your agreement.
- Payment is processed by our payment providers (such as Shopify Payments, Shop Pay, PayPal, Google Pay and Venmo). We never see or store your full card number. By ordering you authorize the charge and confirm that you are permitted to use the payment method.
- Promotions, discount codes and free-shipping offers may be changed or withdrawn at any time, apply only during the period and to the products we state, cannot be combined unless we say so, and are not applied retroactively. One discount code per order. Codes issued to a specific customer are not transferable, and we may cancel orders that misuse a code.
4. Shipping, returns and cancellations
Production times, delivery estimates, and what happens with delayed, lost, misdelivered or damaged packages are described in our Shipping Policy. Returns, exchanges, refunds, cancellations and our limited warranty are described in our Returns & Exchanges Policy. Risk of loss passes to you when the carrier delivers the package to the address you provided; until then, a lost package is our responsibility, as described in the Shipping Policy.
5. Your account and communications
If you create an account you are responsible for keeping your login details confidential and for orders placed through it, unless caused by our failure to secure it. When you place an order we send you transactional emails about it (confirmation, shipping and delivery updates, and questions about your personalization). If you enter a mobile number at checkout and choose to receive shipping updates by text, we send order-status texts to that number; message and data rates may apply, and you can reply STOP at any time. We send marketing emails or texts only if you separately opt in, and you can unsubscribe at any time using the link in any message or by emailing us.
6. Reviews and content you submit
Where our reviews come from. Reviews on this site come from two places: reviews customers submit here after a purchase, and reviews that customers of our Etsy shop left on Etsy for the same products, which we have imported. Some Etsy customers left a star rating without writing a comment; where that is the case the rating is shown without review text. Where there is text, it is the customer's own words. We do not write reviews, we do not pay for or offer discounts or other incentives for reviews, and we do not edit their substance. We display negative reviews as well as positive ones and do not remove a review because of its rating. We may remove or decline to publish content that is unrelated to our products, contains another person's personal information, is unlawful, defamatory, obscene, harassing or discriminatory, contains malicious code, or that we have reason to believe is false or not written by a customer.
What you give us. When you submit a review, photo or other content, you give Joyful Tidings a non-exclusive, royalty-free, worldwide license to use, display and share it in connection with our store and marketing, and you confirm that it is yours, that it reflects your honest opinion and experience, that you have disclosed any material connection to us, and that anyone identifiable in a photo has agreed to its use. You can ask us to take down content you submitted by emailing cs@jtbridal.com. Nothing in these Terms limits your right to review us honestly anywhere, including negatively.
7. Our content and trademarks
The Joyful Tidings name, logo, product names, photographs, descriptions, designs and site design are owned by us or our licensors and are protected by copyright and trademark law. You may browse and shop, but you may not copy, scrape, reproduce or use our content for any commercial purpose without our written permission.
8. Acceptable use
You agree not to use the site for anything unlawful; to interfere with its operation; to attempt to access data or accounts that are not yours; to place fraudulent orders; or to submit false, misleading or abusive content. We may suspend access or cancel orders that violate these Terms.
9. Third-party links and services
The site may link to other websites and uses third-party services such as payment processors and shipping carriers. We are not responsible for their content or practices, and their terms apply to your use of them.
10. Warranties and limitation of liability
Our products. We stand behind everything we make. Our limited warranty — what we do if an item is wrong, damaged in transit, or defective — is set out in our Returns & Exchanges Policy. That limited warranty is in addition to the implied warranty of merchantability and any other warranty that applies by law, which we do not disclaim. It does not cover normal wear, misuse, damage after delivery, or the hand-finished variations described in Section 2.
The website. The website itself (as distinct from the products you buy) is provided "as is" and "as available." We do not promise that it will be error-free or uninterrupted.
Limits on liability. To the fullest extent permitted by law, Joyful Tidings will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of the site or a product — including lost profits, or the cost or disappointment of a wedding or other event for which an item did not arrive in time or as expected — and our total liability for any order will not exceed the amount you paid for that order. These limits do not apply to liability for death or personal injury caused by a defective product or by our negligence, to fraud or willful misconduct, or to any other liability that cannot be limited under applicable law (including California Civil Code section 1668).
Your legal rights. Some states, including California, do not allow certain limitations of liability or of implied warranties for consumers. Nothing in these Terms limits any right you have under the law of the state or country where you live that cannot be waived, including your rights under the California Consumers Legal Remedies Act, the Song-Beverly Consumer Warranty Act, and the federal Magnuson-Moss Warranty Act.
11. Responsibility for content you supply
If a third party brings a claim against Joyful Tidings because personalization, artwork, a photo or other content you supplied infringes that party's trademark, copyright, right of publicity or other rights, or because you used the site for an unlawful purpose, you agree to reimburse us for the losses and reasonable costs we incur as a result, to the extent caused by you. This section does not apply to claims caused by our own negligence or breach.
12. Governing law and where disputes are resolved
These Terms and any dispute between you and Joyful Tidings are governed by the laws of the State of California, without regard to its conflict-of-law rules, except that if you live outside California you keep the protection of any consumer law of your state or country that cannot be waived by agreement. To the extent permitted by law, any legal action arising out of these Terms or your purchase will be brought in the state or federal courts located in San Bernardino County, California, and you and we each consent to the jurisdiction of those courts. This does not limit your right to bring a claim in small claims court, or in any other court where the law gives you the right to sue as a consumer (in California, see Code of Civil Procedure section 395(b) and Civil Code section 1780(d)). Nothing in this section prevents either of us from seeking an injunction to protect intellectual property.

13. Notice to California residents
Under California Civil Code Section 1789.3, California residents are entitled to the following notice: this site is operated by Joyful Tidings, email cs@jtbridal.com. Complaints or requests for further information may be sent to that address, telephone number or email. The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
14. Changes to these Terms
We may update these Terms from time to time. The version posted on this page at the time you place an order is the one that applies to that order. Continued use of the site after a change means you accept the updated Terms. We keep dated copies of earlier versions; email us to request the version that was in force when you ordered.
15. General
Neither of us is responsible for a failure or delay caused by events outside our reasonable control, such as fire, flood, severe weather, epidemic, carrier or postal disruption, supplier failure, labor dispute, government action, or power or internet outage. If such an event delays your order, our Shipping Policy explains your options, including a refund for anything we have not yet personalized.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies linked above, are the entire agreement between you and Joyful Tidings about your use of the site and your orders. You may not transfer your rights under these Terms; we may assign ours to a successor of our business.
